We suspect that these Kingston flash drives are counterfeit

lawmore-products-dt200We strongly suspect that the Kingston flash drives listed on ebay by Lawmore Products (ebay ID lawmore-products) will prove to be counterfeit and fake capacity.

The seller is apparently dropshipping at the moment whilst awaiting a consignment from China.

We strongly advise lawmore-products check serial numbers and test the consignment immediately on arrival before releasing payment to the supplier as we don’t think these will be genuine.

The seller should get in touch with any buyers and explain that they may not be genuine and that they will be contacted when the situation has been investigated.

We advise everyone who buys flash memory items to test them with the free program h2testw irrespective of where they were purchased – otherwise you run the risk of data loss and corruption.

Report your fake if testing confirms you have purchased fake capacity flash memory on ebay.

UPDATE 18/10/09
Well, well, well, what is going on with Lawmore Products? The seller claimed the flash drives originally listed under the ID lawmore-products shown in the listing above were genuine and that serial numbers checked out. Then the seller refunded the buyers – presumably because they were in fact fakes. All good and well.

However, then Lawmore Products then set up the new ID lmproducts0909 and listed these:

Well you couldn’t get a more obvious fake than this! This model of Kingston was never made in 64GB capacity. The drive shown in the picture appears to be a discontinued 2GB drive. Did Lawmore Products think we wouldn’t notice?

It would “appear” that one of these was sold under the ID lmproducts0909 at just after 11am on 16th October. Notice that the seller offered free P&P using 2nd class delivery in the listing. We wonder how, then, the “buyer” managed to leave feedback at just after 8.30pm the following day.

We saw no other delivery options in the listing so we wonder whether the buyer and the seller could be one and the same. We have come to the conclusion that this is probably deliberate fraud.

  2. I have noticed that improducts9090 is not registered as a business seller. Is posing as a private individual not against trading law, and classed as tax evasion?

    Also – On neither of each sellers adverts, is there the ‘proper’ form of contact information, as required by Ebay and UK law.

    This section is a brief introduction to the most important rules and regulations relating to the goods you intend to sell and the information you’re legally obliged to give to people when you advertise those goods for sale (for example on eBay).

    The Unfair Commercial Practices Directive (April 2008) makes it an offence in the UK for a business to falsely represent itself as a private individual. So if you are misleading potential buyers into thinking that you are a private individual when you are in fact a business seller (ie: by not registering as a business seller with eBay), you will be breaking the law.

    You must include information about your business in your listings – Electronic Commerce Regulations and Distance Selling Regulations

    Under the Electronic Commerce (EC Directive) Regulations 2002 you must provide the following information in the Business Seller Information section of your listings, your About Me page or on a Shops page no more than one click from your main Shop page:

    full contact details for your business;
    details of any relevant trade organisations to which you belong;
    details of any authorisation scheme relevant to your online business;
    clear indications of price, if relevant, including any delivery or tax charges and your VAT number, if your online activities are subject to VAT.

    …………… none of these seem to appear on these sellers listings. Therefore, I deduce, that any threat, from a company that is trading illegally, avoiding paying taxes, and breaking the law in numerous ways, should be taken ‘light heartedly’. If this/these company(ies) is(are) VAT registered, then they face the full might of the Customs & Excise officials. Just the mention of those words can make a grown man weep.

    I would advise copying each advert into a Word document as formal proof of UCPD offences.

    Reading through the various reports, I personally cannot see any slander occurring. Only factual comments about advertised products. Public threats, by Lawmore-products or LAWMORE-PRDOCUTS could, in the final analysis, backfire.

  3. I assume we are talking about the transaction between the following dealers (1) lmproducts0909 registered in Staffordshire, and (2) vvebtrader, also registered in Staffordshire..
    Note the cunning use of vv in the name that looks like a “w” on many displays, except with the font used on the traders feedback profile where it is clearly VV.

  4. When a seller starts up on ebay, the feedback rating is at zero until the first positive feedback is received.

    Not too many buyers are keen on buying unless they see that 100% on the seller.

    lmproducts0909 must have been delighted to receive a glowing positive feedback so quickly and therefore get that instant boost to 100%.

    The postal service in that part of the UK must be amazingly fast.

    If that is how fast second class post is, first class must be nearly as quick as sending an e-mail!

We at lawmore-products make every effort to maintain a high customer satisfaction rate and will NOT put this at risk to make ‘A quick buck’ We appreciate the site bringing this to our attention, however the further comments made by ‘Traveler’ and by your site itself is slander, and could be in breach of the Defamation Act 1996 (c. 31). The dirves were tested and were found to be the correct memory, We are no longer selling the kingston datatraveller nor are we trading on eBay but through our own site.   9. I did not think I was going to find this seller being foolish enough to argue the point that the recent, blatantly obvious, fake capacity, counterfeit drives under the recent ID were genuine too.

    This was the reponse to an ebay member who advised that the 64gb DT1’s were fake capacity counterfeits:

    “We will certainly look into this, we brought direct from supplier, where they have come with serial numbers, warranty and authentic stickers, we also used H2TestW to test them and found them to be 64gb, We will contact kingston for further information.”

    I wonder if the seller will tell us these came from a reputable wholesaler too?

    Will the seller claim these drives will also verify with Kingston?

    And, of course, these will test with h2testw and show up as 63.9gb, won’t they?

    Our invesigations suggest you are correct in stating that a genuine 64GB flash drive would not test at 63.9GB.

    We are inclined to agree that it seems highly unlikely that the seller actually tested with h2testw. We also doubt very much that serial numbers were actually checked with Kingston as suggested.

    We had hoped this might be a genuine seller who made a mistake. However, we now wonder whether this may be yet another case of deliberate fraud.

  12. No genuine 64gb drive will test at 63.9gb.

    I do not believe the seller has performed any other test apart from sticking a drive in a spare usb slot.

    To carry on with the sale of counterfeit, fake capacity goods is fraud.

    I would like to see the seller come back with the real test results, not just what shows in properties.

  13. Update on our shipment:
    The listing you have shown was our drop shipping items we will not be going ahead with the full purchase of the products due to the fact that there is a possibility they could be counterfeit.
    However the batch we originally ordered have a arrived today. It comes in Kingston packaging, with a Kingston Warranty, It displays the Kingston/verify flash sticker which checks out. It is also complete with serial number.We have tested with your above mentioned programme and found them to be 63.9gb in capacity. Unless you can think of anything else we can do to verify these they will be offered for sale ?

  14. We are very glad to hear from you. We have been looking for genuine sellers on ebay for a long time! Sadly, we suspect that your supplier was fraudulent. Let us know how you got on with checking serial numbers with Kingston and testing the drives. We trust that if you find (as we strongly suspect) the drives are fake that you will refund any buyers. Hope you did not pay the supplier yet! If you did (and paid by credit card) your credit card company can probably do a chargeback.
