babybenfib auctions counterfeit Kingston DT310 openly on ebay

There seems to be a recent trend among ebayers who bought counterfeit Kingston flash drives from China to sell them openly as not being genuine. The listing above (ebay item number 190478648183) from babybenfib is an example of this.

Do ebayers like babybenfib not realise that by selling counterfeit goods they are breaking the law and that they could be prosecuted and face a jail sentence? Stating that a counterfeit item is not genuine is not a defence!

Also, in the case of flash memory counterfeit items are fake capacity. Fake capacity flash memory is dangerous – eventually everything saved becomes corrupted unless measures are taken to overcome the fraudulent programming that fools the operating system into seeing a larger capacity than actually exists. Anyone who buys such items will eventually face data loss.
