Ebay & International Law – Listings And Transactions – Dealing With Counterfeit Fake USB Flash Drives, MP Players, Memory Cards

eBay insists that listings and transactions comply with the laws of the countries where both the seller and the high bidder reside. Users are responsible for ensuring that their transactions are lawful in both countries. eBay strongly suggests that users educate themselves about the laws of their own country and the countries where they plan to do business.

In addition the paypal / ebay complaints that you may submit for the fake flash drive, mp player or memory card, you may also want to consider submitting policy complaints on the seller. Some potential areas that a seller may infringe on local laws or regulations in your country.

1. Starting with the mailing package that the flash device was shipped in. Hopefully, you still have the mailing package.

Starting with the Customs declaration (CN22 form):

A) Did the seller indicate that the product was a gift?

If so, this is not true, and your country customs laws should consider this to be fraud.

B) Is the description on the CN22 correct?

If not, then your country customs laws may be infringed.

C) Did the seller indicate the country of origin?

If not, then again your customs laws may be infringed.

The CN22 form contains the following declaration.

I, the undersigned, whose name and address are given of the item certify that the particulars give in this declaration are correct and that the item does not contain any dangerous article or articles prohibited by legislation or by postal or customs regulations.

If the seller did not complete the form correctly you could also complain to the postal authorities is the sellers country and Ebay.

2. Regarding the contents of the package:

A) Did the flash drive, mp player or memory card or the packing that it came in have “country of origin” markings?

If not, this could be in violation of your countries customs laws or consumer protection laws.

You can use this information to help you pursue your claim if any of the conditions Randy mentioned are found. It can also cut to the quick about any arguments or issues with a Paypal claim. The more evidence you have that laws are being broken, the easier it should be.

We think this is exactly the kind of information eBay could leverage very quickly to help you. Instead of having to argue or dispute on the validity of fake or not fake. We all know that a tested items indicates whether it is or not, but this is another angle and it could be a lot easier to pursue.

SOSFakeFlash had uncovered a new counterfeit ring on eBay selling fake memory cards. The false capacities are 16GB and 32GB. Generic and Transcend 32GB Fake memory cards have been sold to unsuspecting eBay buyers.

On June 22 2009 SOSFakeFlash issued the following alert on the internet to warn eBay members: zjlee08 Ebay Fake Flash Seller High Alert – China. This eBay seller had sold over 3000 items of fake flash capacity, including the brand name Transcend. It was estimated that zjlee08 earned over $60,000 US. When eBay suspends a seller, all listings are removed. Victims are not able to review the item they purchased. The details of the item vanish. This hides the sellers fraud and makes it difficult for many less experienced members to file a claim with PayPal. The FrankenFlash project views this behavior as aiding and abetting criminal activity.

SOSFakeFlash asks victims of false capacity nand based technology to report in using their: Report A Fake tab. Victims are asked to provide seller addressing information. As a result they were able to connect the dots for another counterfeiting ring.

Once more, it is clear that shipping of counterfeit flash nand technology is from Hong Hong with the “Controller” center being in China. Hong Kong is the conduit to unleash fake flash on the global public who continue to suffer data loss from these digitally altered memory cards, mp players and usb flash drives. SOSFakeFlash feels that little is being done by the Chinese Government to contain and stop the traffic. Profit rules. Damage to the global public is of little consequence. The noble ideals once held by the “revolution” are dust. A faint memory doomed to be nothing more than a footnote in history, the sacrifices made by many, for absolutely nothing. In refusing to address the problem, there is only one conclusion, China wants to enjoy the vices and weaknesses found in the western world.

Shame! Millions in China gave up so much and sacrificed. So that you would one day rush to become like us? Shame! For allowing the sale of data poison to continue!

It is amazing! A seller with a score of 94.7 is actually able to sell and list on eBay! It can mean only one thing to SOSFakeFlash. Nobody home. Or eBay no longer has any employee’s left . Or they have laid off anyone with an IQ greater than 10! Is eBay THAT DESPERATE FOR MONEY?
